Most people who play a role in the legal process are aware of court servers. Nevertheless, persons who do not play a part in the legal system do not know them well. There are quite a number of erroneous beliefs regarding what exactly these serves do and their legal obligations.

Once the legal papers have been served, the court servers are obligated to present tangible evidence that the documents were in fact served.

The evidence of documents having been served that is presented is known as an affidavit of service. This needs to be notarized and taken to the company or person who requested for service to be effected. Servers are required by law to serve legal papers in the correct manner as provided by their state laws. Service of court papers laws are distinct in different states, thus, each individual servers may carry out the service differently.

Service of legal papers is essential for a number of reasons, but the most essential reason is to ensure that procedural law is followed in the country. Another reason why servers play a major role in the civil society is since they ensure that court documents are properly served. If documents fail to be served in the right manner, the court cannot make a decision on a case involving an individual if he was not informed of it in a legal way.

If service of court papers is deemed to have been done incorrectly, the entire suit could be thrown out. It is therefore extremely crucial for servers to know the laws of their state touching on proper service of defendants. Servers need to be familiar with all the legislation that are used when carrying out service on defendants. It is key to note that court servers are individuals who have some legal training, thus they may be held liable if they fail to carry out proper service.
